Chapter 13 - Bankruptcy
Filing a chapter 13 petition allows individuals with regular income to restructure and repay their debts over time, typically between 36 and 60 months. Chapter 13 cases are commonly referred to as “wage earner” cases because your future income is used to repay existing debts. People typically file a petition under chapter 13 to save their homes from imminent foreclosure or when they do not meet the eligibility requirements to file under chapter 7 of the Bankruptcy Code. Chapter 13 allows you to spread your debts over the life of your repayment plan and make installment payments directly to the chapter 13 trustee who then pays creditors on your behalf. After successfully making all plan payments, you will receive a discharge of debts covered under your chapter 13 plan provided you satisfy all other requirements. Chapter 13 helps individuals who have the means and desire to repay their debts if given a little more time. It also protects co-debtors (people who are jointly obligated on your consumer debts) from collection attempts even if they have not filed bankruptcy. Schedule a call today so we can discuss whether filing a petition under chapter 13 of the Bankruptcy Code will help you.
